Church of Bass Official Win3 Sweepstakes Rules

NO PURCHASE OR VOTE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.

1. ELIGIBILITY: Sweepstakes is open only to residents of the USA who are 13 years age or older on the date of entry. If you’re a minor, you must ask your parent’s permission before entering this Sweepstakes. Employees of the Church of Bass (“Church of Bass”), and members of their immediate families (spouse, parents, children, and siblings and their spouses) are not eligible. The Sweepstakes is subject to all applicable federal, state, municipal, and local laws and regulations. This Sweepstakes is void where prohibited or restricted by law, including but not limited to Rhode Island, New York and Puerto Rico.

2. TO ENTER: The Church of Bass Sweepstakes also known as prize draw (“Sweepstakes”) begins 12:01 am EDT on October 13, 2010 and ends 11:59 pm EDT on October 31, 2010 (“Promotion Period”).

i. You must sign up to receive our $50k Daily Reminder Email (“$50k Daily Reminder”) or the Church of Bass Newsletter (“Newsletter”) at http://goo.gl/d5t4. We will send you a Daily Voting Reminder each day until the end of the Promotion Period. Each Daily Voting Reminder email will include 1 or more trackable link(s) that directs you to “Vote” (as defined below) for the Church of Bass in Pepsi’s Refresh Everything Project (“Pepsi Refresh”). You are automatically entered to win the Church of Bass Sweepstakes when you click a link to vote for the Church of Bass in Pepsi Refresh during the Promotion Period. A separate random drawing for each day of the Promotion Period shall be held. To be entered into a daily drawing, an entry must be received by midnight EST on the same day.

a. A “Vote” for purposes of this Sweepstakes, means that you have clicked one of the trackable links in our Daily Voting Reminder during the Promotional Period. If you arrive at the Pepsi Refresh website from some other non-trackable link (including our website), your entry will not be considered valid. Only a link originating from a Daily Voting Reminder will be considered a Vote.

b. You can only Vote once per trackable link per calendar day. Subsequent votes the same day or votes through sms are not valid entries.

ii. All clicks on the trackable vote link shall be attributed to the email address the Daily Voting Reminder was originally sent to by the Church of Bass. Clicking on a forwarded version of the Daily Voting Reminder will be attributed to the email address that the Church of Bass sent the email to, not to the recipient of the forwarded email.

iii. By clicking a trackable vote link on a Daily Voting Reminder, you receive one(1) Sweepstakes entry. You can only vote one time for each Daily Voting Reminder trackable link and only once per calendar day. Any subsequent votes on the same Daily Voting Reminder do not earn you additional Sweepstakes entries.

iv. Normal Internet access and phone/usage charges imposed by your online/phone service may apply and shall be the winners’ sole responsibility, if applicable. Free Internet access is available at your local library. Free email addresses are available at gmail.com, hotmail.com, and other providers. You are solely responsible for choosing an email and Internet solution that is best for you.

  1. RANDOM DRAWING: All daily entries must be received by midnight each day to be eligible for the daily drawing for that day. One prizewinner will be selected for each day of the Promotion Period in a random drawing from among all eligible entries received for that day’s drawing. Odds of winning depend on the total number of eligible entries received.
  2. PRIZES: The daily prize will vary, and will be announced in the Daily Voting Reminder for a specific day. Daily winners will be announced within 72 hours of each drawing. Daily winners will be listed in the Daily Voting Reminder and also be notified via the email address provided when they signed up for the Daily Voting Reminder. Winners must respond 48 hours of notification to the Church of Bass’s prize notification email to claim a prize. Winners who fail to respond forfeit their prize and the Church of Bass will perform another random drawing to select a replacement winner. Return of any prize or prize notification as undeliverable will result in disqualification and an alternate winner will be selected.
  1. GENERAL RULES: Winning is contingent on fulfilling all requirements set forth in these Official Rules and the Pepsi Refresh official rules. Acceptance of prize constitutes permission to use winner’s name, likeness, photographs, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration except where prohibited by law. The Church of Bass assumes no responsibility or liability for damages, losses or injury resulting from your acceptance or use/misuse of prize. Any taxes, surcharges, fees, duties, or tariffs required to accept delivery of the prize are the sole responsibility of the winner. All entries become the Church of Bass’s sole property of and none will be returned. In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The “authorized account holder” is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Each potential winner may be requested to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, the Church of Bass reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and award prizes from among all eligible survey entries received prior to cancellation or termination and all eligible mailed entries received. Sponsor reserves the right to withdraw the transmission of this promotion and award the prizes from among the eligible entries received prior to the date of the withdrawal.

The Church of Bass is not responsible for incomplete, illegible, misdirected, damaged, lost, postage due or late mailed entries, or for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate or by any human error which may occur in the processing of the entries in this Sweepstakes. The Church of Bass is not responsible for any typographical error in the printing of these Official Rules, administration of the Sweepstakes or in the announcement of the Sweepstakes prizes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE Church of Bass RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. By entering into this Sweepstakes, each entrant accepts and agrees to be bound by these Official Rules.
  3. GOVERNING LAW: The Sweepstakes and the rights and obligations of the entrants will be governed and controlled by the laws of the state of Washington, USA, and any disputes shall be referred to the exclusive jurisdiction of the Washington state, US courts.
  4. PRIVACY: The email address of entrants will be used to conduct the prize drawings and to facilitate the notification of the prize winner. In addition, we will track whether and how often the reader of a specific e-mail we send clicks on our trackable vote link(s) in order to determine whether a valid sweepstakes entrance was made. Thus, your email address will be associated with your click history in our Daily Voting Reminder. We will not share your personally identifying information with a third party except as required for the functioning of this sweepstakes. If you are selected as a winner you will be required to disclose your name, date of birth and address to the Church of Bass. You or your parental guardian(s) agree to the processing of personal information about you for the purposes and in the manner set out above. If you are selected as a prizewinner, you or your parental guardian(s) must also agree to release this personally identifying information in order to collect your prize.
